Terms of Service

The agreement

These terms are an agreement between you and Strickland Consulting, a sole proprietorship in Florida (“Zeal”, “we”, “us”), for the Zeal apps (ZealPresenter, ZealCast, ZealLens, ZealRemote and ZealView), zealstage.com and the services behind them (together, “Zeal”). By using Zeal you agree to them. If you use Zeal for a church or other organization, you agree on its behalf and confirm you may do so. Our Privacy Policy explains how we handle information.

Accounts and your church

You need an account for features that sync or connect to other services. Keep your sign-in details private; you are responsible for what happens under your account.

Accounts belong to organizations (usually a church). An organization’s owners and administrators decide who joins and what role each person has, and are responsible for the people they let in.

Plans and billing

Zeal has a free plan and paid plans. Paid plans belong to the organization, not to one person, and renew automatically each month or year until cancelled.

Purchases made in an app are billed by Apple under Apple’s terms. Refunds are handled by Apple: request one at reportaproblem.apple.com. Cancel at any time in your Apple account settings, and the plan runs to the end of the period you paid for.

We may change prices; a change applies from your next renewal after we tell you. Some features have fair-use limits, which we describe in the apps.

Your content

Songs, services, media and anything else your church puts into Zeal remain yours. You allow us to store, copy, sync and display it only as needed to run Zeal for you.

You are responsible for having the rights to what you display and stream, including song lyrics, music, images and video. Zeal does not provide licences such as CCLI or streaming licences, and does not check whether you hold them.

Acceptable use

Do not use Zeal to:

• break the law or infringe anyone’s rights;
• get into accounts, organizations or systems you are not allowed into, or test our security without our written permission;
• interfere with Zeal or overload it, or copy, resell or reverse engineer it except as the law allows;
• send harmful code, spam, or content that harasses or endangers others.

Other services

Zeal can connect to services such as Planning Center, CCLI SongSelect, YouTube and Facebook. Their own terms apply to your use of them, and we are not responsible for them.

Zeal uses YouTube API Services. If you connect YouTube, you agree to be bound by the YouTube Terms of Service.

Our software

Zeal, including the apps, their design and the Zeal name and marks, belongs to us. We give you a personal, non-exclusive, non-transferable licence to use it under these terms. If you send us feedback, we may use it without owing you anything. We may change, add or remove features over time.

Disclaimers

Zeal is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that Zeal will be uninterrupted or free of errors.

Live services depend on networks, devices and other companies’ services outside our control. Keep a backup plan for anything that must not fail.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of Zeal. Our total liability for any claim relating to Zeal is limited to the greater of the amount your organization paid for Zeal in the 12 months before the claim, or US$100.

You agree to cover our reasonable costs, including legal fees, from claims by others that arise from your content or from your breaking these terms.

Ending

You can stop using Zeal at any time. We may suspend or end access for a serious or repeated breach of these terms, and will tell you why unless the law or safety prevents it.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, and you and we agree to their jurisdiction.

If we change these terms we will update the date above and tell you when the change is significant; using Zeal after that means you accept them.
